About Our Consultation
Reliability and Accountability are essential factors when dealing with professional services. For the peace of mind of any potential client, our experience speaks for itself and our many Testimonials will be presented for you to view at the point of consultation. However, below are some of the questions and frequently encountered scenarios falselyaccused.co.uk has received during these consultations.
Q: I already have a legal team but I would like to obtain a second opinion as I’m not sure they have the right experience. Why should I take advantage of your consultation?
A: The purpose of our consultation is to clarify matters for you. You provide the information and we add our knowledge and expert experiences. We will give you a fair and objective second opinion on your matter. Defence teams, like any other trade, sometimes offer guarantees that are absolutely unrealistic in order to capture new clients. We will never do this! Unfortunately, "talk" does not make a defence, action does. At the end of the consultation we put the whole thing together for you to make sure that you can make an informed judgement about how to progress your matter.
Q: I went on the web and found lots of solicitors, support and voluntary organisations that offer free email and telephone consultations. Why should I pay for a consultation with you?
A: Many of the people who book their consultation with us have already obtained free legal advice, whether it was from a solicitor or a support or voluntary organisation. falselyaccused.co.uk are a fiercely independent firm of specialists. We are not a support or voluntary organisation, charity, campaigners or protestors. We do not see our clients as "Projects" (we do not approve or endorse or are in anyway connected to, or affiliated to any other organisation’s work). Our own experience of similar situations and our aspiration to ensure that it doesn’t happen to others sets us apart. Defence team, like any other trade, sometimes offer free initial consultations in order to capture new clients. Their focus is therefore on getting you to come back to them as a paid client so that they can recover the time they spent with you for free. With our consultation we don’t necessarily expect to see you again. The focus on our consultation is to give you sufficient information to try and solve your matter in the most effective way. This way, you get a fair and effective advice and we get paid for our expert time.
Q: Why can’t you tell me on the telephone or in an email what I need to know?
A: As we have previously stated, we only give limited general advice on the telephone. This is why so many people get themselves into a sticky situation, prior to seeking expert advice in these complex matters. If you decide to book a consultation with us and during the consultation we give you the wrong advice as you would have paid for it, you should able to sue us under our “Public Liability Insurance” for misrepresentation, you can also report us to the Trading Standards Office. But remember our full satisfaction guarantee!
Q: Can I supply you information in advance of the consultation?
A: We do in fact ask you to complete our questionnaire and email us (info@falselyaccused.co.uk) as much information as you can ahead of the consultation. This enables us to prepare in advance and devote the consultation time to providing you with solutions. On rare occasions where the amount of information that you send to us is exceptionally high, we may advise you in advance that your matter is not suitable for a 2 hour fixed fee initial consultation.
Q: What is discussed during the consultation?
A: Based on the information you send us (via our questionnaire), we will have a very good idea of what your matter involves. Our consultation is based on our experience, which dictates that we explain exactly what we can and cannot do for you. During the consultation we will explain the legal process whether you are going to trial or you or a loved one has been wrongly convicted. We can then put you in touch with the right solicitor and / or barrister to complete your defence team. You will be informed of the likely costs involved during the consultation should you decide to instruct our team of experts. Please note during a consultation we have been “pounced on” with a question that we would not be able to answer, we would seek further advice to which we have access and we would then contact you with our answer. Hopefully by the end of the consultation our effort to identify and offer a possible solution to your matter will be accomplished, and of course you will be more knowledgeable about your matter.
Q: Why can’t I tell you “direct information” about my case during the consultation?
A: As a general rule, the law requires us to take instructions from a solicitor dealing with your case, we may at any point during your matter become a witness of fact (meaning, we may have to give evidence on your behalf). Therefore, there might be a conflict of interest. Any discussion relating to “direct information” to your matter must be discussed with your solicitor. If at the point you wish to instruct us we will then seek “A Letter of Instruction” from you and your solicitor stating that we are permitted to carry out lawful enquiries. We must also point out that there is various legislation (Such as the Sexual Protected Materials Act) preventing us discussing details until we have received written authorisation from you solicitor.
Q: Am I permitted to tape record the consultation?
A: Obviously we understand that it is an emotional time and therefore things may be forgotten during the consultation. We have nothing to hide but you must inform us prior to the start of the consultation should you wish to record it. If you decide not to inform us and we later establish that you have done so without our consent, then we may stop acting for you. We will send you information via email about what was discussed during the consultation therefore you will have a written report to peruse at your leisure.
Q: How do I know that you will not just get me to spend more money with you after the initial consultation?
A: Have a look at our Testimonials at the point of consultation and see what our clients are saying about us. How you wish to proceed after the consultation is entirely a matter for you. We would have been paid for our expert time and will not pressure you to proceed one way or the other thereafter.
Q: What if following the consultation I want to instruct you to do further work for me?
A: In such cases we identify with you what further work needs to be done (We will supply you with our “How we work” document), we would also advise you to take a look at the Funding page on our website.
Q: What if I don’t have a good case, would you tell me this?
A: Yes we will. Whenever we can, we will give you a straightforward answer (whether it’s positive or negative). We know that you want to hear the truth either way.
Q: How many times in the past 5 years have people asked for their money back?
A: Once. We go out of our way to give people excellent value for money. We do appreciate, however that occasionally we might not be able to satisfy everyone. Our consultation is backed by our full satisfaction guarantee, which means that if following the consultation you felt that you did not receive value for money, we will not only refund £100.00 (maximum / excludes *Travel and Disbursement costs) but we will also send you a letter of apology, together with £20.00 gift vouchers as a token of good will.
Q: Do you conduct consultations after your normal office hours?
A: Yes we do. Many people, especially parents of young children can only find quiet time during the late evenings. We therefore conduct consultation at clients homes to suit their schedule. However, additional travel and disbursements (such a hotel stay if required, toll) fees apply.
